Employer and broker portals terms of use
Effective as of June 22, 2016
This terms of use agreement governs usage of our employer portal and broker portal.
As a user or delegate user of either or both of these portals (the “System”), you agree you have read, understood and will adhere to the following:
All users
Access to Protected Information
You understand if you use the system, you might see Protected Information.
“Protected Information” identifies, or could be used to identify, a member or patient. It can be sent out or saved using any form or medium. It also includes oral or recorded information about the health of a person. It may be about the health care given to a person, or a health care payment. This kind of information also includes demographic details. That could be a name, address, date of birth, phone number, etc.
You agree:
- You will not view Protected Information you do not need for a business purpose
- You will not view Protected Information beyond your approved access level
- You will not share your System username, password or other information that someone could use to sign in as you
- You will not share your System account with anyone
- You will let your employer (and HealthPartners, if you have administrative access to the system) know about any violation
You understand that if you do not follow this agreement, HealthPartners has the right to take away your access to the System without any advance notice.
Business associate agreement
Your employer or yourself could have a business associate agreement with HealthPartners (or its partners). If so, you agree to follow it.
Users who have administrative access
If HealthPartners lets you give System access to others in your company or organization, you also agree to the following:
- You will give access only to employees of your company or organization
- You will not let any Third-Party Vendor use the System without HealthPartners’s prior written consent (a “Third-Party Vendor” is any person or entity that offers services to you or who acts on your behalf to use the System)
- You will keep a current record of every person within your company using the System. The record will include, at minimum, each person’s name, username, password and the level of access given. If an approved HealthPartners agent asks for the record (as, for example, for auditing or monitoring), you will make it available.
- You are responsible for every person’s actions when you give them access to the system. Accordingly, you will monitor for unauthorized activity, such as:
- Viewing, using or sharing Protected Information that’s not needed to treat a member or patient, or receive payment for a member’s or patient’s health care
- Using or sharing usernames or passwords
- Creating shared accounts
- Viewing Protected Information beyond approved access levels
- Any other activity that goes against this agreement
- You will report any violations to us within two business days of discovery, and you will work with us to remove a user’s System access (if needed)
- You understand that certain actions – including, but not limited to, failing to report violations or failing to follow this agreement – could result in your access to the System being taken away
- You understand that your site may use the System to get electronic information, including remittance advice and other transactions required by law. If you lose your System privileges, this will be construed as failure to maintain your account, and HealthPartners will not be at fault for making the transactions. You understand and agree that you may contract with a Third-Party Vendor as another way to receive these transactions from HealthPartners.
Changes to this agreement
HealthPartners reserves the right to change this agreement at any time. By using the System, you are agreeing to any changes made to this agreement.
